Community Development Department


The Community Development Department provides services related to the divisions of Planning & Zoning, Building, Business Tax Receipts, and Code Enforcement. Services are provided on a hybrid basis with both City of Fellsmere staff and consultants fulfilling the aforementioned functions. This mixed-model has been implemented in response to the unique market pressures present in Florida that demands a high level of responsiveness and elasticity. Additionally the structure of the Department allocates the cost to end users to minimize subsidies from the general fund.

The City of Fellsmere is focused on being a hospitable environment for both businesses and residents. This is the policy of City Council and the charge of staff. The City seeks to facilitate opportunity and this philosophy is reflected throughout the functions of this and every department.

Planning & Zoning Division

Planning & Zoning Division provides services regarding community development, urban revitalization, long-range planning, and historic preservation. Planning & Zoning staff reviews and processes applications for site development plans, conditional use permits, plats, annexations, and rezonings, among other development requests. The division also presents development proposals before various boards, including the City Council, Planning & Zoning Board, Board of Adjustment, and Community Redevelopment Agency. Planning & Zoning staff implements the goals, objectives, and policies of the City’s Comprehensive Plan, and also coordinates comprehensive plan evaluation and updates.

Building Division

The Building Division performs plan reviews, issues building permits and performs inspections for all construction including: (Single-family residences, commercial buildings, fences, swimming pools, screen enclosures, storage sheds, re-roofs, water hook-ups, additions, repairs, remodels and other construction). The Building Division also provides the issuance of Land Clearing, Grubbing and Tree Removal permits. The Building Division services are provided primarily by Safebuilt with support services from the Permit Clerk.

Code Enforcement Division

The Code Enforcement Division enforces municipal codes to ensure the health, welfare, and safety of the residents. Code Enforcement places an emphasis on achieving voluntary compliance. Code actions are both self-initiated and in response to complaints.

Code Enforcement Division services are provided primarily through city staff with support from Independent Inspections.

Business Tax Receipts Division

The Local Business Tax Receipt is imposed for the privilege of doing business in the City of Fellsmere. Anyone that engages in any type of business within the City limits is required to have a City of Fellsmere Local Business Tax Receipt.

All receipts are sold or renewed by the City beginning July 1 of each year, are due and payable on or before September 30 of each year, and expire on September 30 of the succeeding year. Receipts not renewed by September 30 become delinquent and subject to a penalty of 10% for the month of October and an additional 5% for each month of delinquency thereafter. However, the total delinquency penalty may not exceed 25 percent of the tax for the delinquent establishment.

Business Tax Receipt Division services are provided primarily by the Permit Clerk with support from the Code Officer and Independent Inspections.
