Land Development

Landowners and developers who are interested in developing or redeveloping their property within the City of Fellsmere must first obtain development approval from the City.  When applicable, permits from outside agencies may also be required.  Information contained on this website provides an overview of the development process and should not be used as a substitute for the Land Development Code (LDC). 

Development is defined within the City’s LDC as follows:  The carrying out of any work to modify site conditions including, but not limited to, building, clearing, filling, excavation, grading, or planting of vegetation; or the making of any material change in the size or use of any structure or the appearance of site conditions; or the placement of equipment or materials upon such site.

This definition includes typical development scenarios, such as constructing new buildings or site improvements, but also less obvious actions such as a change in use of a property or the clearing of a property.  Development includes all of these various actions to ensure that when such actions do occur, they are conducted in compliance with the land development regulations contained within the LDC.  The LDC requires that prior to any development, a development permitmust first be obtained. 

A development permit is defined as: Any building permit, zoning permit, preliminary subdivision plan, subdivision or other plat approval, site and development plan approval, comprehensive plan land use amendment, rezoning, certification, special exception, variance, environmental permit or any other official action of City Council or any other state or local government commission, board, agency, department or official having the effect of permitting development of land located within the geographic area subject to the provisions of the City of Fellsmere Land Development Regulations. Development shall include all activities set forth in Section 380.04, Fla. Stat., as amended.
